Estate Litigation

Most often a Will is prepared with consideration and attentiveness. In some cases, a Will may seem unfair. A deceased may have had legal obligations that were not followed. If you find yourself facing an estate dispute, Gray Lawyers can assist you with a variety of estate litigation matters.

In British Columbia, a person is required to adequately provide for their family members. If you are a child or a spouse that has been disinherited or unfairly treated under a Will, you may have a claim to vary or change the Will.

You may also have concerns over whether a Will is valid. In British Columbia, a Will must meet certain standard to be considered a valid Last Will and Testament. Disputes may also arise if a person alleges that the will was signed under duress or by force, threat, or intimidation. In some cases, questions arise as to whether the person was mentally fit to create a Will. If a person has passed without a Will, there may be disputes as to how the estate should be distributed among surviving family members.

Whether you need assistance with disputes resulting from an application under the Wills, Estates & Succession Act, Resulting Trusts, Joint Tenancy, challenging the validity of a Will, seeking to change or vary a Will, or the improper administration of an estate, we are here to assist you.
